Property Boundaries & Access

Clearly defined property boundaries help establish property ownership, determine which trees belong to you, and prevent conflicts with neighbors. Well-marked boundaries are especially important during timber harvests. Maintain survey markers, fences, signs, and other boundary markings.

FENCES AND FENCE LAW

Illinois Fence Law (765 ILCS 130) generally requires adjoining landowners in counties with populations under 1 million to share responsibility for boundary fence installation and maintenance. A fence is not required between every property, but when one landowner requests a fence, neighboring landowners may be required to share the cost.

TRESPASS

Illinois law allows landowners to prohibit unauthorized entry by providing notice, including posting conspicuous signs at property entrances. Purple paint may also be used to mark property boundaries when current legal requirements are followed.

If someone trespasses or removes trees without permission, contact your county sheriff or nearest Illinois State Police district office. The property owner or authorized representative generally must file the complaint.

EASEMENTS

Easements give others certain rights to use or access your property. Review your deed and property records for easements that may affect your woodland, and consult a qualified professional if you have questions.

YOUR RESPONSIBILITY

Marking your property against trespass does not eliminate your responsibility for maintaining a reasonably safe property.
